🔐 YOUR DATA, YOUR CONTROL. Vortech is a technology provider only. We do not own, sell, or monetize your business data. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data. By using the Platform, you consent to the practices described herein.

01 Information We Collect

We collect information you provide directly, information collected automatically, and information from third-party sources.

Account & Business Information: When you register, we collect your name, email, company name, business address, phone number, industry type, and subscription preferences.

Operational Data (User-Entered): Job records, technician names/IDs, service locations, job notes, revenue entries, split configurations, and dispatch preferences. This data is entered by you for your operational use only.

Device & Usage Information: IP address, browser type, operating system, device identifiers, pages viewed, features used, time spent on Platform, and clickstream data.

Location Data: When technicians use the mobile app, we collect approximate or precise GPS location to enable real-time dispatch and tracking. Location collection occurs only when the app is active and can be disabled in device settings.

Cookies & Similar Technologies: We use cookies, web beacons, and local storage to remember preferences, analyze usage, and improve functionality. See Section 10 for details.

⚠️ Important: Vortech does not collect sensitive personal information (SSN, bank account numbers, health data) unless you voluntarily enter it into operational fields. We strongly advise against entering such data into the Platform.

02 How We Use Your Information

We use collected information solely to provide, maintain, and improve the Vortech Platform:

03 Legal Basis for Processing (GDPR)

For users in the European Economic Area (EEA) and United Kingdom, we process personal data under the following legal bases:

04 Information Sharing & Disclosure

We do not sell, rent, or trade your personal information. We may share data only in these limited circumstances:

Service Providers: Trusted third parties who assist with hosting, infrastructure, analytics, customer support, or payment processing. All providers are contractually required to protect your data and use it only for specified purposes.

Legal Requirements: If required by law, subpoena, court order, or government request, or to protect the rights, property, or safety of Vortech, our users, or the public.

Business Transfers: In connection with a merger, acquisition, sale of assets, or bankruptcy, user information may be transferred as a business asset. Users will be notified via email or prominent notice before any change in control that affects data handling.

With Your Consent: When you explicitly authorize sharing for a specific purpose.

05 Data Retention & Deletion

We retain personal information only as long as necessary to provide the Platform, comply with legal obligations, resolve disputes, or enforce agreements.

Account Data: Retained while your subscription is active. Upon cancellation, account metadata may be retained for up to 90 days for security and billing reconciliation, then permanently deleted.

Operational Data: Job records, technician data, and revenue entries are stored only while your account is active. Vortech is not a data archive. We do not guarantee indefinite retention of historical operational data.

Deletion Requests: You may request deletion of your personal information by contacting support@vortechpro.com. We will respond within 30 days. Note: Deleting your account will permanently remove all associated data with no recovery option.

📋 Best Practice: Export CSV reports of your operational data regularly and store them in your own secure systems. Do not rely on the Platform as your sole record retention system.

06 Your Rights & Choices

Depending on your location, you may have the following rights regarding your personal information:

To exercise any right, contact support@vortechpro.com with "Privacy Request" in the subject line. We will verify your identity and respond within 30 days.

Do Not Track: Our Platform does not currently respond to browser Do Not Track signals, as we do not use third-party advertising trackers.

07 International Data Transfers

Vortech is headquartered in the United States. If you access the Platform from outside the U.S., your information may be transferred to, stored in, and processed in the United States and other jurisdictions where our service providers operate.

For transfers from the EEA, UK, or Switzerland to countries without an adequacy decision, we rely on appropriate safeguards, including Standard Contractual Clauses approved by the European Commission or UK International Data Transfer Agreement, as applicable.

By using the Platform, you consent to such transfers as described in this Policy.

08 Children's Privacy

The Vortech Platform is intended for business users aged 18 and older. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected such information, we will delete it promptly. If you believe a child has provided us with personal information, please contact support@vortechpro.com.

We implement commercially reasonable technical and organizational measures to protect personal information, including:

We use cookies and similar technologies to enhance functionality and understand usage:

Essential Cookies: Required for Platform operation (authentication, security, session management). Cannot be disabled.

Functional Cookies: Remember preferences, language settings, and UI customizations.

Analytics Cookies: Help us understand how features are used to improve the Platform. Data is aggregated and anonymized.

Managing Cookies: You can control cookie preferences through your browser settings. Note: Disabling essential cookies may impair Platform functionality.

We do not use third-party advertising cookies, pixel trackers, or cross-site behavioral tracking.

11 Third-Party Links & Services

The Platform may contain links to third-party websites or integrate with third-party services (e.g., mapping APIs, communication tools). This Privacy Policy does not apply to those third parties. We encourage you to review their privacy practices before providing any information.

Vortech is not responsible for the content, security, or privacy practices of external sites or services.

12 Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, or legal requirements. Material changes will be communicated by:

14 CCPA/CPRA Notice (California Residents)

Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), California residents have additional rights:

Categories of Sources: Directly from you, automatically via Platform usage, from service providers.

Business Purposes for Collection: Service delivery, security, analytics, legal compliance, communications.

Categories Shared for Business Purposes: Service providers (hosting, analytics, support) under confidentiality agreements. We do not "sell" or "share" personal information as defined by CCPA.

Your CCPA Rights: Right to know, delete, correct, and opt-out of sale/sharing (though we do not sell/share). To exercise rights, email support@vortechpro.com with "CCPA Request" in subject line. We will not discriminate against you for exercising these rights.

Authorized Agent: You may designate an authorized agent to submit requests on your behalf. We may require written authorization and verification of your identity.

15 GDPR Notice (EU/UK Residents)

If you are located in the European Economic Area (EEA) or United Kingdom, the following additional information applies:

Data Controller: Vortech Technologies™, Los Angeles, CA, USA. For GDPR purposes, we act as a data controller for account and usage data, and as a data processor for operational business data you enter (where you are the controller).

International Transfers: Data transferred outside the EEA/UK is protected via Standard Contractual Clauses or other approved mechanisms. You may request a copy of these safeguards by contacting us.

Automated Decision-Making: We do not use solely automated decision-making or profiling that produces legal or similarly significant effects.
